🎈 SERVICE AGREEMENT & LIABILITY RELEASE
Art & Party Kingdom, Inc. — Illinois Contract
This Service Agreement (“Agreement”) is a legally binding contract between Art & Party Kingdom, Inc. (“Company,” “Designer,” “we,” or “us”) and the person completing and signing this form (“Client,” “you”).
By booking services, Client confirms that they have carefully read, understood, and agreed to all terms outlined below and assumes full responsibility to communicate these terms to all event stakeholders, venue coordinators, and contractors.
1️⃣ Reservation, Pricing & Payment Terms
To secure décor services, a non-refundable retainer of $50 is required via Zelle (630-251-3534).
Reservations are confirmed only after payment is received and approved in writing by the Company.
All décor pricing is based on design complexity, materials, and setup time, and quoted by order.
A detailed quote will be provided prior to booking confirmation.
Weekend Minimum:
Bookings taking place Friday after 3 PM through Sunday require a minimum of 3 consecutive hours for setup and design.
Travel Fee Policy:
Services include up to 15 miles from ZIP 60193.
Beyond 15 miles: $50 base + $1.50 per additional mile (one-way GPS measurement).
Client also covers tolls, venue access, and parking fees if applicable.
The remaining balance is due in full before installation begins.
Failure to pay may result in service cancellation, and full contracted payment remains due.
Any verbal upgrades or last-minute changes (e.g., adding arches, garlands, signage, or delivery re-routing) are billable and must be paid before execution.
2️⃣ Changes, Cancellations & Rescheduling
Design or order changes must be submitted at least 10 days prior to the event.
Schedule changes are subject to Company availability only.
If Client cancels within 10 days of the event or fails to reschedule, the full contract amount remains due to cover reserved time and purchased materials.
On-site overtime or extended setup:
- Allowed only if schedule permits
- Charged at the agreed hourly labor rate
- Payable immediately upon request
3️⃣ Delivery, Installation & Environment Requirements
Client agrees to provide a safe, accessible, and suitable space for décor installation, including:
- Clear entry and sufficient loading area
- Climate-controlled space (65–80°F)
- Flat, clean surfaces free of sharp objects or confetti residue
- Venue access at least 1 hour before setup and 1 hour after event for teardown
Company is not responsible for décor damage caused by heat, cold, humidity, sharp objects, smoke machines, or guests handling installations after completion.
4️⃣ Equipment, Materials & Ownership
All rental frames, bases, stands, backdrops, and other materials remain the property of Art & Party Kingdom, Inc.
Client is financially responsible for loss or damage to any Company property during rental.
Client agrees not to move, relocate, or alter balloon décor once installed unless authorized by the Company.
5️⃣ Photography & Marketing Use
Client grants Company perpetual permission to photograph completed décor for use in:
- Website and social media
- Advertising and printed materials
- Portfolio or educational showcases
If photography restrictions apply, Client must notify Company in writing at least 24 hours prior to setup.
No refunds apply due to photo restrictions.
6️⃣ Weather, Outdoor Installs & Safety
Outdoor décor is subject to environmental conditions.
While professional materials and methods are used, balloons are not guaranteed to withstand extreme heat, cold, rain, or wind.
Client assumes full responsibility for outdoor installations once setup is complete.
Company may refuse installation or remove décor if conditions are unsafe or installation is impossible to secure (e.g., high winds, uneven or wet ground).
Full payment still applies.
7️⃣ Parking, Venue Access & Delays
Client must provide convenient, prepaid parking near the event site and clear instructions (gate codes, check-in, etc.) 24 hours before arrival.
Delays caused by lack of access do not extend setup time or reduce payment.
8️⃣ Liability & Indemnification
To the fullest extent permitted by Illinois law, Client agrees to defend, indemnify, and hold harmless
Art & Party Kingdom, Inc., its owners, employees, and subcontractors, from any claims arising from:
- Property damage
- Guest injury or allergic reaction (e.g., latex sensitivity)
- Improper handling of décor after setup
- Venue hazards or third-party negligence
Client understands balloons are temporary art installations that naturally deflate or oxidize over time and that latex balloons are biodegradable but not reusable.
9️⃣ Governing Law — State of Illinois
This Agreement is governed by the laws of the State of Illinois.
Any disputes will be handled exclusively in Cook County, Illinois courts.
The prevailing party in litigation may recover attorney fees, court costs, and collection expenses.
🔟 Complete Understanding & Authority to Sign
This Agreement represents the full understanding between the parties and supersedes any prior communications.
No verbal changes are valid. Modifications must be made in writing and signed by both parties.
By signing below, Client acknowledges having authority to approve décor services on behalf of the event.
