SERVICE AGREEMENT & LIABILITY RELEASE
Art & Party Kingdom, Inc. — Illinois Contract
This Service Agreement (“Agreement”) is a legally binding contract between Art & Party Kingdom, Inc. (“Company,” “Artist,” “we,” or “us”) and the person completing and signing this form (“Client,” “you”). By booking services, Client confirms that they have carefully read, understood, and agreed to all terms outlined below and assumes full responsibility to communicate these terms to all event attendees and guardians.
1️⃣ Reservation, Hourly Rates & Payment Terms
To secure the date and time of services, a non-refundable retainer of $50 is required, paid via Zelle to 630-251-3534.
Reservation is confirmed only after payment is received and booking is approved in writing by the Company.
All pricing is based on $150 per hour per artist.
Billing is strictly time-based, regardless of:
- number of children served
- queue length
- speed of selection
- guest arrival delays
Weekend Minimum:
Bookings taking place Friday after 3:00 PM through Sunday require a minimum of 2 consecutive hours per artist.
Travel Fee Policy:
Services include up to 15 miles from ZIP 60193.
Beyond 15 miles: $50 base + $1.50 per additional mile (one-way GPS measurement).
Client agrees to cover tolls, access fees, and parking reimbursement upon arrival.
Remaining balance is due in full upon Artist’s arrival, prior to any services beginning.
Failure to pay results in service cancellation on-site and full contracted payment still due.
Any verbal or last-minute service upgrades, additional time, or extra artists requested during the event must be paid before service is delivered.
2️⃣ Schedule Changes, Cancellations & Overtime
Rescheduling requires minimum 7 days’ written notice and is subject to availability only.
If Client cancels, reduces hours, or fails to reschedule with proper notice, full contracted amount remains due.
Overtime:
- Only if scheduling permits
- Paid immediately
- Full hour increments
- Same per-artist hourly rate applies unless otherwise quoted
Requesting additional service without payment constitutes breach of Agreement.
3️⃣ Safety, Supervision & Right to Refuse Service
Client is solely responsible for supervision and behavior of all guests.
Artist is not responsible for childcare or crowd control.
For safety:
- Balloons may pose choking hazard to children under 8
- Children under 2 years must be held by an adult during services
- Offensive, violent, disruptive, intoxicated, or aggressive behavior → service refusal
If conditions become unsafe, unsanitary, or abusive, Artist may stop and leave immediately with full payment still owed.
Artist has sole discretion in determining whether any guest will be serviced.
4️⃣ Equipment & Supply Protection
Artist’s equipment, tools, and materials are professional assets and may not be handled by guests.
Client accepts financial responsibility for any lost, stolen, damaged, or contaminated equipment at full replacement cost.
Company may cease services if violations persist.
5️⃣ Staffing & Crowd Management
Company may assign:
- Additional artists
- Assistants
- Line managers
as needed for guest safety, crowd flow efficiency, and quality of service.
Staffing decisions remain at Company’s discretion.
6️⃣ Photography & Promotional Use
Client grants the Company perpetual and unrestricted rights to use photos and/or video taken during the event featuring:
- Artwork created by the Company
- Guests receiving or posing with services
- Event environment and decor provided by Company
These may be used in:
- Website and social media
- Digital and print advertising
- Promotional publications and portfolio features
If photography restrictions apply to specific individuals, Client must provide written notice at least 24 hours prior and enforce limitations on-site.
No refunds will apply due to photo restrictions.
7️⃣ Weather Protection & Working Conditions
Client is responsible for providing a safe and appropriate work area that is:
- Covered and protected from rain, snow, wind, direct sun, or extreme temperatures
- Clean, well-lit, and equipped with table + chairs if required
- Free from hazards including pools, grills, confetti cannons, uneven ground, amplified bass vibration, or overcrowding
If improper or unsafe conditions exist upon arrival and are not resolved immediately, Artist may leave and full payment remains owed.
8️⃣ Parking, Access & Delays
Client must provide complimentary or prepaid parking close to the venue.
If access instructions (gate codes, check-in, security, etc.) are not provided 24 hours prior and delays occur, service time is not extended or discounted.
9️⃣ Health & Hygiene Restrictions
Artist may decline service to anyone with visible signs of:
- Rash, fever, respiratory illness
- Open wounds, cold sores, active skin issues
- Lice, conjunctivitis, contagious conditions
No refunds apply due to service refusal for hygiene/safety concerns.
🔟 Indemnification & Liability Release
To the fullest extent allowed by Illinois law, Client agrees to protect, indemnify, and hold harmless:
✅ Art & Party Kingdom, Inc.
✅ Its owners, contractors, and staff
from any claim, injury, illness, choking, allergic reaction, property damage, negligence of guests, or venue conditions.
Client acknowledges that balloon twisting, face and body painting, and tattoo art involve inherent risks which Client assumes on behalf of all minors under their supervision.
1️⃣1️⃣ Governing Law — State of Illinois
This Agreement is governed by the laws of the State of Illinois.
Any legal action will be enforced exclusively in Cook County, Illinois courts.
The prevailing party may recover attorney fees, court costs, and collection expenses.
1️⃣2️⃣ Complete Understanding & Authority to Sign
This Agreement represents the full understanding between Client and Company.
No verbal changes are valid. Any modification must be in writing and signed.
By signing below, Client confirms legal authority to approve services for all minors present.
